European Commission: Public Consultation on the Review of the Significant Market Power Guidelines
The European Commission has launched a public consultation on the review of the Significant Market Power (SMP) Guidelines (adopted in 2012), in view to update them in time for the implementation of the new European Electronic Communications Code.
The SMP Guidelines represent the European Commission guidelines on market analysis and the assessment of the significant market power under the EU regulatory framework for electronic communications networks and services. These guidelines are addressed to the national regulatory authorities that have to take them into utmost account when defining relevant markets and assigning telecommunications operators with SMP, in view of imposing on them appropriate regulatory obligations to redress competition problems identified on a forward looking basis.
The Commission is particularly looking for input on the need to update provisions related to market definition, single and joint SMP, the relevance of the SMP Guidelines concerning regulatory obligations, powers of investigation and cooperation for the purpose of market analysis, procedures for consultation and publication of national regulatory authorities decisions.
The public consultation is addressed to EU member states, national regulatory authorities, national competition authorities, electronic communications providers, academics in law and economics, and consumers.
