Indian high court issues global order to take down defamatory content
The High Court of Delhi has issued a global order addressed at Facebook, YouTube and Twitter to remove a video about the book Godman to Tycon that is allegedly defamatory towards the yoga celebrity Swami Ramdev. The platforms argued that an Indian court is not able to control content well outside its jurisdiction. However, the Court ruled that the fact that the content was uploaded from India binds the platforms to strictly follow the current intermediary liability laws of the country, which require such platforms to expeditiously remove or disable access to illegal content. Also, the court affirmed its jurisdiction beyond India based on the fact that the illegal content was uploaded from its territory.
