The Italian Data Protection Authority has ordered OpenAI to comply with measures related to data privacy, transparency, and data subjects’ rights by April 30th, after which the authority will lift its temporary order limiting the processing of Italian users’ data. OpenAI must make an information notice about data processing available on its website, remove references to contractual performance for the legal basis of processing, and provide tools for data subjects to exercise their rights. OpenAI must also implement an age-gating system and submit a plan for an age-verification system by September 30th, 2023. OpenAI must promote an awareness-raising campaign by 15 May on the use of personal data for training algorithms, and the authority may take additional measures depending on the outcome of its inquiries.
