The EU Digital Markets Act met with political agreement
The Digital Markets Act (DMA) has been met with a political agreement between the EU Parliament and the EU Council on 22 March 2022. Originally proposed by the EU Commission in December 2020 to address the negative consequences arising from the behaviours of several online platform providers, the DMA will designate providers who control core services on the Internet as gatekeepers. The DMA foresees a robust supervisory structure whereby the Commission will be the sole enforcer of the regulations in cooperation with the authorities of Member States. A gatekeeper might be subject to a fine of up to 10% of its total global turnover for non-compliance, and 20% for repeated breaches. The Commission will also be able to carry out market investigations when needed. The DMA complements the enforcement of the competition law regime at the EU and national levels.
